COMPUTER BOOKSHOPS LIMITED ("CBL") ON LINE TRADING
TERMS AND CONDITIONS
This website is provided by CBL for use by its existing trade customers ONLY
for the purposes of electronic ordering of the products contained in our on-line catalogue appearing on this website
("the Products").
If you are not an existing trade customer, but wish to
become one, please follow the links located on the homepage entitled
"Register". CBL reserves the right to refuse to accept orders from and/or
supply Products to any individual or company for any reason whatsoever.
The terms and conditions which shall govern the contractual
relationship between you and CBL, including the order and supply of the
Products through this website, are contained in the contract which you entered
into with CBL at the time you were accepted as and became an existing trade
customer of CBL ("the Contract").
The terms and conditions set out below are supplemental to
the Contract and apply to on-line ordering and supply of the Products through
this website. In the event of any conflict between the terms and conditions of
the Contract and the terms and conditions set out below, the terms and
conditions set out below shall take precedence.

Basis of Order

Until accepted by CBL, any order placed through this website constitutes your offer to
CBL to purchase the Products. (CBL will signify its acceptance of this offer by sending you an
electronic acknowledgement of your order.) CBL's acceptance of your order brings into existence
a legally binding contract between you and CBL.

Exclusions/Limitations of Liability

Whilst CBL has taken every reasonable precaution in compiling this website, this
website is provided on an "as is" basis. Neither CBL, nor any contributors to
the website makes any representations or warranties of any kind (express or implied) with
respect to the contents or operation of this website (including, but not limited to all documents and
graphics posted on this website) and any such representations and warranties are hereby disclaimed.

All warranties, conditions and terms of any kind, whether implied by statute or common law, including without
limitation any warranty as to correspondence with description, satisfactory quality or fitness for
purpose, are excluded to the fullest extent permitted by law.

Except in respect of death or personal injury caused by CBL's negligence, CBL
shall not be liable to you by reason of any representation (unless
fraudulent), or any implied warranty, condition or other term, or any
duty at common law or under any express terms of this agreement, for any
indirect, special or consequential loss or damage (whether for loss of
profit or otherwise), costs, expenses or other claims for compensation
whatsoever (whether caused by the negligence of CBL, its employees or
agents or otherwise) which arise out of or in connection with the supply
of the Products or their use or resale by you.

CBL's aggregate liability under or arising in connection with this agreement,
whether in tort (including negligence) or for breach of contract or
otherwise howsoever arising shall in no event exceed the price of the
Products supplied under this agreement.

2.5

CBL will not be liable for any damages or losses, whether direct or indirect, that
you may suffer as a result of computer service or systems failure,
including but not limited to server failure, access delays or
interruptions, data non-delivery or mis-delivery, domain name system
failure, delays in provision of the Products, breaches of security or
unauthorised use of the system arising from "hacking" or
otherwise, even if CBL has been advised of the potential for such
damages and even if CBL may reasonably foresee the potential for such
damages.

You and CBL hereby expressly exclude any rights of third parties who may otherwise
be entitled to enforce the terms of this agreement as if they were a
party to it or otherwise able to rely on the provisions of the Contracts
(Rights of Third Parties) Act 1999, as enacted or modified.

Price/Availability of the Products

The price payable for the Products that you order are as posted on this website.
You are referred to the Contract for payment and delivery terms.
|

3.2
|
|
CBL reserves the right at any time, prior to CBL's supply of your order, to revise
its prices without notice.
|
|
3.3

|
All orders for Products are subject to availability. CBL's acceptance of your Order
does not signify availability of the Products. You will be advised of
any delay in delivery of the Products relating to availability.

Correction of Errors

Any typographical, clerical or other error or omission in any document
posted on this website, including, but not limited to any catalogue or
Product information, price list, quotation, invoice, acceptance of offer
or other documentation or information shall be subject to correction
without any liability on the part of CBL.

and/or services. If you do not wish to receive any such information, you

modify, distribute, republish, display, post or transmit any part of
this website without CBL's prior written consent.
